This master thesis is dealing with analysing the lack of strategy in a Romanian construction company. Making an analysis of the external environment and internal factors has revealed several issues that are analysed throughout this paper. A plan was agreed with the company to be implemented. In agreement with the company, a frame was set, and this study is limited, focusing only on burning issues for the company as internal communication, lack of strategy and lack of personnel.

In this article I defend the capability approach by focusing on its built-in gender-sensitivity and on its concern with comprehensive outcomes and informationally-rich evaluation of well-being, two elements of Sen's work that are too rarely put together. I then try to show what the capability approach would have to gain by focusing on trans-positional objectivity (as Elizabeth Anderson does) and by leaving behind the narrow confines of states in favor of a more cosmopolitan stance. These preliminary discussions are followed by (...) two more precise applications. At first, I show how a gender-sensitive capability approach that respects the criteria of trans-positional objectivity and cosmopolitanism can enhance the agency of women inhabiting third-world societies. I turn next to show how mainstream feminism can insulate itself against criticisms such as bell hooks' by switching to trans-positional objectivity in public reasoning. (shrink)

This article is devoted to analysing the ethical commitments underlying research methodology on “brain drain” and leading participants in the public debate to deny the human right of emigration for skilled persons. Here, we identify five such commitments : to consequentialism, prioritarianism and nationalism, we add sedentarism and elitism. Based on this analysis, we argue that even though the emigration of the most talented would be a loss for the country of origin, this loss is not sufficient to require that (...) migrants themselves compensate it – either by tax payments (e.g. Bhagwati’s tax proposal) or by not exercising their right to emigrate. Moreover, to interpret public investment in education as the source of migrants’ further obligations to their country is to view education rather as a source of dividends than an access to opportunity that present generations owe to futures ones. Are intellectual property rights for talented people justified by Rawls’ criteria of justice? In this paper, I argue that Rawls’ theory of justice is ill-equipped to answer this question. Tailored for rival goods and, as a result, centred on the distribution of benefits, it tends to restate questions of justice about unequal rights as questions about economic inequalities. Therefore, it lacks the tools necessary to distinguish among different forms of incentives for talented people. Once social and economic inequalities observe equality (...) of opportunity and improve the least advantaged, the theory is indifferent as to whether talented people are allowed to compete for monopoly rights or for direct financial reward. This paper argues that by overestimating the importance of citizenship rights, the ethics of immigration turns away from the more serious problem of closed borders. Precisely, this contribution is a threefold critique of Carens’ idea that "justice requires that democratic states grant citizenship at birth to the descendants of settled immigrants" (Carens, 2013: 20). Firstly, I argue that by making 'justice' dependent on states and their attributes (birthright citizenship), this idea strengthens methodological nationalism which views humanity as naturally divided into (...) bounded nation-states. Secondly, I analyze its justification and argue that grounding (citizenship) rights on the existence of social connections is logically and morally problematic. Thirdly, I analyze its scope (granting rights to the descendants of the ‘settled’) and its method of implementation (granting citizenship rights automatically ‘at birth’). While from a less sedentarist perspective, no one can be considered ‘settled’ in advance, I will express some doubts that granting citizenship rights is always automatically a way to extend people’s rights. All in all, I argue that by its justification, scope and method of implementation, this idea moves us away from, rather than gets us closer to, an open-borders world. (shrink)

The aim of this article is to show that refusing to legalize the status of undocumented immigrants who have been long-term residents is a serious violation of human rights. The "right to have rights" ­ a term coined by Hannah Arendt and developed by Sheila Benhabib ­ should be construed first and foremost as the right to a legal existence. We take issue with consequentialists who warn that legalizing the status of undocumented aliens will encourage further undesirable immigration, for withholding (...) legal status in order to deter illegal newcomers is neither efficacious nor just. Migrant women are often stereotyped. Some scholars associate the feminization of migration with domestic work and criticize the “care drain” as a new form of imperialism that the First World imposes on the Third World. However, migrant women employed as domestic workers in Northern America and Europe represent only 2% of migrant women worldwide and cannot be seen as characterizing the “feminization of migration”. Why are migrant domestic workers overestimated? This paper explores two possible sources of bias. The first is (...) sampling: conclusions about “care drain” are often generalized from small samples of domestic workers. The second stems from the affect heuristic: imagining children left behind by migrant mothers provokes strong feelings of injustice which trump other considerations. The paper argues that neither source of bias is unavoidable and finds evidence of gender stereotypes in the “care drain” construal. (shrink)

In the present chapter I try to determine to what extent the public policies adopted by Romanian governments following the fall of the communist regime contributed to alleviating the most egregious past injustice, the Holocaust. The measures taken for memorializing the Holocaust will be analysed through the lens of a mixed reparatory justice – relational egalitarian account. Employing such a framework entails a focus on symbolic reparations, meant to promote civic trust, social solidarity, and encourage the restoration of social and (...) cultural capital in societies affected by historical injustices. Such symbolic reparations can include public atonement, changing street names, establishing memorials, funding museums, including Holocaust study in the national curriculum, setting national days for the commemoration of the Holocaust, etc. The need for symbolic reparation has become increasingly clearer in the literature on Holocaust memorialization, and the present paper intends to go a step further, by providing researchers with a theoretical approach that can be used to make better sense of the effects of measures taken as part of the process of Holocaust remembrance. In the chapter I also address the issue of determining who the duty-bearers should be. I argue that there could be several indicators for reparatory justice, including in this case compensation programs and the establishment of institutions that would allow dialogue between descendants of the victims and descendants of the perpetrators, a sine qua non condition for restoring social trust in communities marked by violations of human rights, especially of such a scale as the Holocaust. It is often argued that development aid can and should compensate the restrictions on migration. Such compensation, Shachar has recently argued, should be levied as a tax on citizenship to further the global equality of opportunity. Since citizenship is essentially a ‘birthright lottery’, that is, a way of legalizing privileges obtained by birth, it would be fair to compensate the resulting gap in opportunities available to children born in rich versus poor countries by a ‘birthright privilege levy’. This article sets (...) out a defence of three theses. The first states that equality of opportunity is incompatible with, and cannot be achieved in, segregated territories. The second posits that to believe that material equality compensates the injustice of restrictions on movement is to commit a ‘sedentarist mistake’. The third affirms that any citizenship levy, including the egalitarian and non-sedentarist formula I’m proposing, would be better understood as a penalty rather than a tax. (shrink)

Centuries II and III of Francis Bacon’s posthumous natural history Sylva Sylvarum are largely dedicated to sound. This paper claims that Bacon’s investigation on this topic is fruitfully read against the background of the Aristotelian theory of sound, as presented in De anima commentaries. I argue that Bacon agreed with the general lines of this tradition in a crucial aspect: he rejected the reduction of sound to local motion. Many of the experimental instances and more theoretical remarks from his natural (...) history of sound can be elucidated against this wider concern of distinguishing sound from motion, a theme that had been a staple of Aristotelian discussions of sound and hearing since the Middle Ages. Bacon admits that local motion is part of the efficient cause of sound, but he denies that it is its form, which means that sound cannot be reduced to a type of local motion. This position places him outside subsequent developments in natural philosophy in the seventeenth century. (shrink)

En 2010, les femmes constituaient la majorité des migrants qualifiés présents dans 20 pays membres de l’OCDE. Comment expliquer l’absence d’intérêt pour le phénomène de « féminisation de la migration qualifiée » que ces statistiques permettent d’observer ? À l’inverse, comment comprendre l’engouement pour l’expression « féminisation de la migration » (tout court) alors que les données ne la confirment pas ? Pour répondre à ces questions, cet article analyse les usages de l’expression « féminisation de la migration » et (...) identifie son origine dans la théorie de la division internationale du travail. Centrée sur une critique de la mobilité du capital, cette théorie prédit une féminisation de la migration et l’associe aux emplois peu qualifiés. Cependant, les recherches qui s’en inspirent risquent de perdre de vue le diplôme de l’enseignement supérieur qui représente le véritable passeport pour les femmes originaires des pays en développement. This article argues that there are at least three different versions of methodological nationalism: state-centrism (unjustified supremacy granted to the nation-state), territorialism (understanding space as divided in territories), and groupism (equating society with the nation-state’s society). If these three versions are logically distinct, as it will be shown, the typology can serve as a tool to weight the influence of methodological nationalism in the social sciences. The paper has three sections arguing that 1) the three versions are all present in (...) the literature on methodological nationalism without always being distinguished; 2) the epistemological problems raised by methodological nationalism are sometimes misunderstood as ontological or normative questions about globalization and national borders; 3) the three versions of methodological nationalism can be shown to be logically independent by a few examples. Methodological nationalism is the assumption that nation-states are the relevant units for analyzing social phenomena. Most of the social sciences recognized it as a source of bias, but not the ethics of immigration. Is this field biased by methodological nationalism—and if so, to what extent? This article takes nationalism as an implicit bias and provides a method to assess its depth. The method consists in comparing principles that ethicists commonly discuss when immigration is not at stake with principles advocated in (...) the ethics of immigration. To interpret the results, a distinction between mild and heavy bias is established. When a basic principle in ethics is underdiscussed or absent from the ethics of immigration, the field is ‘mildly biased’. When its negation is commonly advocated, the field is ‘heavily biased’. Here, the method is illustrated with two principles: equal opportunity and reparation. They are common in theories of distributive justice and of corrective justice, respectively. But in the ethics of immigration, scholars often argue for the opposite. Instead of equal opportunity, they implicitly support discrimination based on national origin; instead of sanctions or amnesty for the offenders, scholars plead amnesty for those who they otherwise regard as victims. These preliminary results suggest that the field is heavily biased: methodological nationalism seems to turn ethics into its opposite. (shrink)

This paper analyses the demands for abolishing passports after WWI. The international regime of obligatory passports, as it exists today, is a legacy of the Great War. After the Armistice, two Passport Conferences organized by the League of Nations considered its abolition. Before the second conference, a resolution of the Sixth Assembly of the League of Nations stated that "public opinion is certainly waiting for at least one step towards the most generalized abolition of the passport system ". Was this (...) just a diplomatic figure of speech, or is there really such an "expectation" to be found, for instance, in the press? If there was such an expectation in the press, what was the political orientation of the newspapers in favor of abolishing passports: was it left-wing? This article analyzes a corpus of over 600 articles published in the French press between the World Wars to show, firstly, that interest in the "abolition of passports" was not circumstantial. It's not because the League of Nations is discussing it that the press is discussing it - the opposite is true. The issue of the "abolition of passports" gave rise to a greater number of articles than the League’s "passport conferences". secondly, and more surprisingly, the newspapers that published the most articles on the abolition of passports were center-right and mostly regional. he paper analyses migration flows from the Philippines in two gendered occupations: domestic helpers and computer programmers. The international division of labour theory claims that foreign investment determines migration from developing countries, especially of women, towards low-skilled gendered occupations in developed countries. This paper shows that the division of labour is neither gendered nor international in the predicted sense. For instance, data from Philippines Overseas Employment Agency shows that the theory is Eurocentric as Northern America and Europe are destinations for (...) only 3 per cent of domestic workers’ flows. The paper argues that neo-Marxism creates bias in gender and migration research and hinders understanding of important gendered effects concerning migrants. Two examples of such gendered effects are highlighted here: the higher vulnerability to legislative change of migrant men employed as domestic workers in Italy and the higher penetration of women into computer programming in the migrant flows to the U.S. (shrink)

Unlike other kinds of theories of justice, reparatory justice can only be negatively defined, in non-ideal contexts in which initial wrongs had already been committed. For one, what counts and what does not count as wrongdoing or as an unjust state of affairs resulted from that wrongdoing depends on the normative framework upon which a theorist relies. Furthermore, the measures undertaken for alleviating historical injustices can be assessed only from the vantage point of other, independent normative considerations. In the present (...) paper I argue that this lack of substance is a feature that, far from being problematic, is what makes reparatory justice attractive. The specific example that I put forward is that of a reparatory justice account which seeks to instantiate the desiderata of a sufficientarian theory of justice. At first, distributive justice fills the content of reparatory justice, specifying up to what level reparations in-kind or compensatory measure should go. Afterwards, reparatory justice clarifies and provides epistemic inputs for distributive justice. Reparatory justice thus becomes an epistemic source for distributive justice, in that it provides the means for assessing whether someone’s level of well-being can be traced to her choice or to a wider, historically-sensitive operationalization of her “circumstances”. The high frequency that the question “where are you from” gets asked in ordinary conversation, as well as the insistence on getting private information from people one hardly knows, reveal an interesting phenomenon: an exceptional reversing of the codes of politeness, where indiscretion becomes the rule while efforts to avoid it become impolite acts. In order to explain this phenomenon, this article compares the hypothesis of racial micro-aggression defended by the existing literature and supported by the results of the French (...) survey Trajectories and Origins, to the hypothesis of methodological nationalism. The article shows that the second hypothesis provides a better explanation of how the “where are you from” question is actually practiced. The article’s thesis is that the importance of the “where are you from” question in ordinary conversations is a measure of the banalization of methodological nationalism. (shrink)

Methodological nationalism assumes that, to understand a phenomenon, nation- states are the relevant units of analysis. This assumption has been recognized as a source of bias in most of the social sciences. Does it bias Rawls' understanding of justice, too? This paper argues that it does for at least two reasons. Firstly, what Rawls thinks justice requires on a global scale falls short of what states and international organisations actually do. Secondly, framing the difference principle in national terms, as Rawls (...) did, is a way to increase the “citizenship rent”, or the revenue a person receives just by being citizen of a rich country The paper argues that methodological nationalism biases Rawls’ understanding of justice by affecting both the plausibility and the coherence of his theory. Biases affect much of our epistemic lives. Do they affect how we understand things? For Linda Zagzebski, we only understand something when we manifest intellectual virtues or skills. Relying on how widespread biases are, J. Adam Carter and Duncan Pritchard raise a skeptical objection to understanding so conceived. It runs as follows: most of us seem to understand many things. We genuinely understand only when we manifest intellectual virtues or skills, and are cognitively responsible for so doing. Yet much of (...) what we seem to understand consists in conceptions whose formation could have easily been due to biases instead, and the work of biases is opaque to reflection. If conceptions constituting how we understand things could have easily been due to biases, then we are not cognitively responsible for them because we cannot reflectively appraise what we understand. So, we are mistaken in thinking we genuinely understand most of the time. I will defend the grounding of understanding in intellectual virtues and skills from Carter and Pritchard’s objection. We are cognitively responsible for understanding when we manifest our expertise. We can do so, I will argue, without being required to reflectively appraise what we understand. (shrink)

Critically growing problems of fundamental science organisation and content are analysed with examples from physics and emerging interdisciplinary fields. Their origin is specified and new science structure (organisation and content) is proposed as a unified solution.

The ways in which we exercise intentional agency are varied. I take the domain of intentional agency to include all that we intentionally do versus what merely happens to us. So the scope of our intentional agency is not limited to intentional action. One can also exercise some intentional agency in omitting to act and, importantly, in producing the intentional outcome of an intentional action. So, for instance, when an agent is dieting, there is an exercise of agency both with (...) respect to the agent’s actions and omissions that constitute her dieting behavior and in achieving the intended outcome of losing weight. In our mental lives we exercise intentional agency both in performing mental actions and when we intentionally produce certain outcomes at which our mental actions are aimed. The nature and scope of our intentional agency in our mental lives with respect to controlling the acquisition of mental states such as belief, desire, and intention is a topic that is of interest in its own right. In this essay, I will focus solely on our control over coming to believe. Understanding what sort of control we have our beliefs has far-reaching implications. For instance, theorizing about self-deception and wishful thinking is aided by theorizing about what if any intentional agency we can exercise with respect to acquiring beliefs. Another often mentioned concern that motivates thinking about doxastic agency comes from religion (when conversion requires a change of belief). We also hold persons morally and epistemically responsible for beliefs they have or fail to have. Finally, some deontological theories of epistemic justification require that agents be able to exercise a robust form of doxastic control. Fruitful work on any of these problems requires that we have an account of our intentional agency in acquiring beliefs. There are at least three loci of doxastic control. The first is over acquiring beliefs. The second is over maintaining beliefs. The third is over how we use our beliefs. I am chiefly concerned with the first locus of doxastic control in this essay, but I will say something about the second locus along the way. Also, I will only consider one way we might exercise control over acquiring beliefs. Specifically, I will present an argument against direct doxastic voluntarism (DDV). By “DDV” I mean to refer to the thesis that it is conceptually possible for agents to consciously exercise the same sort of direct voluntary control over coming to acquire a doxastic attitude—such as belief, suspension of belief, and disbelief—that they exercise over uncontroversial basic actions. If DDV is correct, then coming to believe can be a basic action-type. DDV, or something very close to it, was Bernard Williams’ target in his 1973 paper, “Deciding to Believe.” Williams’s argument is widely regarded as having been a failure. But I think that Williams was on to something in his paper. Hence, in this paper, while I do not attempt to resurrect Williams’s argument, I develop and defend a revised argument for a thesis that is quite close to Williams’s. I will proceed as follows. First, I will discuss Bernard Williams’ (1973) failed attempt at showing that DDV is conceptually impossible. This will be followed by a discussion of some constraints on our belief-forming activities. I will then clarify my target a bit more than Williams does in his original paper. Finally, I will present my own argument against the conceptual possibility of DDV. (shrink)

We review the recently proposed universal concept of dynamic complexity and its new mathematics based on the unreduced interaction problem solution. We then consider its progress-bringing applications at various levels of complex world dynamics, including complex-dynamical nanometal physics and living condensed matter, unreduced nanobiosystem dynamics and the integral medicine concept, causally complete management of complex economical and social dynamics, and the ensuing concept of truly sustainable world governance.

Research on the nature of dispositionality or causal power has flourished in recent years in metaphysics. This trend has slowly begun to influence debates in the philosophy of agency, especially in the literature on free will. Both sophisticated versions of agent-­‐causalism and the new varieties of dispositionalist compatibilism exploit recently developed accounts of dispositionality in their defense. In this paper, I examine recent work on agent-­‐causal power, focusing primarily on the account of agent-­‐causalism developed and defended by Timothy O’Connor’s in (...) his work on free will. The metaphor of “care drain” has been created as a womanly parallel to the “brain drain” idea. Just as “brain drain” suggests that the skilled migrants are an economic loss for the sending country, “care drain” describes the migrant women hired as care workers as a loss of care for their children left behind. This paper criticizes the construction of migrant women as “care drain” for three reasons: 1) it is built on sexist stereotypes, 2) it misrepresents and devalues care (...) work, and 3) it misses the opportunity for a theoretical change about how skills in migration contexts can be understood. Au regard du vieux débat sur la « fuite des cerveaux », le devoir de promouvoir le développement des pays pauvres semblait incompatible avec le droit humain à l’émigration. A l’encontre de cette idée, Jagdish Bhagwati a proposé dans les années 70 une mesure qui permettait au personnel qualifié de quitter les pays pauvres, tout en taxant leur revenu au bénéfice de leurs pays d’origine. Cet article discute (et rejette) trois justifications possibles de la taxe Bhagwati. Il conclut qu’une telle (...) mesure ne peut être défendue ni comme une compensation pour ce que le pays aurait gagné si les diplômés n’avaient pas émigré, ni comme une obligation de réciprocité basée sur l’investissement dans l’éducation, ni comme une mesure de diminution de l’inégalité entre les opportunités des migrants et de ceux qui restent au pays. If migration is more effective than aid for fighting poverty, should it replace aid? Not always. This article proposes a criterion that may be used to distinguish between cases where migration should serve as a substitute for development assistance and cases where it should supplement such aid. According to this criterion, development agendas are poverty-efficient when they lift the largest possible number of people out of poverty. Therefore, to be poverty-efficient, development agendas should always aim to complement aid with policies (...) for pulling people out of poverty. Development assistance that is not poverty-efficient should be abandoned and replaced by migration and other policies that can effectively fight poverty. (shrink)

Brain drain critiques and human rights advocates have conflicting views on emigration. From a brain drain perspective, the emigration harms a country when emigrants are skilled and the source country is poor. From the human rights perspective, the right "to leave any country, including one's own" is a fundamental right, protected for all, whatever their skills. Is the concern with poverty and social justice at odds with the right to emigrate? At the beginning of the l970s, the economist Jagdish Bhagwati (...) replied in the negative. He imagined a tax on the income earned by the skilled migrants in the destination country, to the benefit of the source country. He thus sought to reconcile the right to emigration and the brain drain effects. -/- This article argues that there is no need to tax skilled migrants in order to reconcile the right to emigration and social justice. Social justice is not incompatible with the right to emigration but rather with restrictions on mobility. If it is both the case that equal opportunities are a minimal requisite for social justice, and that access to opportunities implies freedom of movement, as I shall argue, then the brain drain criticism doesn't satisfy the minimal requirements of social justice. -/- The article is divided into three parts. Each part rejects one of the possible justifications of the Bhagwati tax, that is, as a way, for skilled migrants, (i.) to compensate the welfare loss occasioned to their country of origin; (ii.) to discharge for their obligation to the national community when it publicly financed their education; and (iii.) to compensate for the resulting inequality of opportunities between themselves and their non-migrant compatriots. A qualitatively new, much more liberal and efficient organisation of science is proposed and justified in connection with emerging international science structures, such as the European Research Council, and growing debates about further role and development of fundamental science. Although the ideas are expressed in terms of "common sense" arguments accessible to a "general" audience, they are based on the rigorous analysis within the recently advanced "universal concept of complexity", which can be applied, due to its universality, also to science (...) structure itself considered as a complex system. We demonstrate thus the application of this ultimate criterion of completeness of a system of knowledge (and viability of related intelligence) that should be able to derive consistent, provable, and practically relevant conclusions about its own purpose, sense, evolution, and current state. Este artículo analiza los compromisos éticos que implica la metodología de la investigación sobre la “fuga de cerebros” y que conducen a los que participan en el debate público a cuestionar el derecho a la emigración de personas calificadas. Se identifican cinco presupuestos de este debate : el consecuencialismo, el prioritarismo y el nacionalismo, así como lo que llamamos “sedentarismo” y elitismo. Este análisis muestra que, si bien la emigración de talentos representa una pérdida para el país de origen, ésta (...) no es razón suficiente para exigir que los migrantes cualificados la compensen, ya sea mediante el pago de un impuesto (la tasa Bhagwati) o a través de la denegación del derecho a emigrar. Además, ver la inversión pública en educación como fundamento de obligaciones para los migrantes es considerar la educación más como una fuente de dividendos que como un acceso a oportunidades que las generaciones actuales deben a las que siguen. An account of what sort of causal integration is necessary for an agent to exercise agency is offered in support of a soft-line response to Derk Pereboom’s four-case argument against source-compatibilism. I argue that, in cases of manipulation, the manipulative activity affects the identity of the causal process of which it is a part. Specifically, I argue that causal processes involving direct manipulation fail to count as exercises of intentional agency because they involve heteromesial causal deviance. In contrast, standard deterministic (...) causal processes do not involve heteromesial causal deviance and are agency-preserving. The upshot is that there is a relevant difference between a causal process involving direct manipulation by another agent and a deterministic causal process that involves no such intervention. If this is right, then Pereboom’s four-case argument does not pose a threat to source-compatibilist theories of free will and moral responsibility. (shrink)

It is revealed the invalidity of the idea that famous Schrodinger's cat thought experiment can be a quantum touchstone. The arguments are: (i) the probabilistic incorrectness in the (over)rating of the subject, (ii) the possibility of imagining non-quantum scenarios but completely similar to that experiment (iii) lack of ratified practical tests having genuine essence (i.e., non-counterfeit). So, the aforesaid experiment appears as a simplistic thought exercise without any notable significance for quantum physics.

The article examines the issue of a necessary connection between the phenomena of law and morality. According to legal positiv- ism, morality is not a criterion of the legitimacy for legal norms. The law can have any content including absolutely immoral (the so-called “separability thesis”). Law issues are not connected with discussing the moral merits of a possible judicial decision. They are only closely related to studying various purely legal phenomena like precedents, judicial discretion, legislatures, etc. The ascriptive legal statements (...) theory proposed by the Oxford School of Law (Herbert Hart, Joseph Raz, and others) serves as the core of contemporary legal positivism. This theory is based on the notion of defeasibility for legal responsibility without any moral reasoning. There, phenomena of law are interpreted as purely linguistic, not social constructions. Analysis of pure law language should provide all the needful tools to extract hidden meaning from any legal norm. This analysis does not require going beyond the legal language since it does not describe any real situations in the world, but merely expresses legal requirements, allowing to legally qualify some observed events. It completely eliminates any references to moral principles from the analysis of legal language. However the critical reconstruction theory of ascriptive legal statements shows limitations of the legal positivism’s analytical approach to the phenomena of law. The example of a fictitious legal collision offered demonstrates limitations of the legal positivism approach to the understand- ing of law phenomena. This collision is a complex conceptual mix of Frankfurt-style examples and imaginary situations in the Trolley Problem widely known in analytical ethics. It clearly demonstrates the possible paradox of a law judgment in situations where conditions for the recognition and cancellation of legal liability are the property of two different (not necessarily openly contradictory) legal norms. It can serve as a strong argument in favor of contemporary theories of natural law (Lon Fuller, John Finnis, Ronald Dworkin, and others), which questioned the possibility of creating a theory of pure law. They considered it senseless and impossible to draw any strict border between moral and legal norms. Immoral law cannot have the particular property of creating a moral obliga- tion to follow such like a law. Law cannot be built on legality only, and the answers to all significant legal questions should be found in moral theories. (shrink)

This survey tries to investigate the truths and deficiencies of prevalent philosophy about Uncertainty Relations (UR) and Quantum Measurements (QMS). The respective philosophy, known as being eclipsed by unfinished controversies, is revealed to be grounded on six basic precepts. But one finds that all the respective precepts are discredited by insurmountable deficiencies. So, in regard to UR, the alluded philosophy discloses oneself to be an unjustified mythology. Then UR appear either as short-lived historical conventions or as simple and limited mathematical (...) formulas, without any essential significance for physics. Such a finding reinforces the Dirac’s prediction that UR “in their present form will not survive in the physics of future”. The noted facets of UR motivate reconsiderations of associated debates on QMS. Mainly one reveals that, properly, UR have not any essential connection with genuine descriptions of QMS. For such descriptions, it is necessary that, mathematically, the quantum observables to be considered as random variables. The measuring scenarios with a single sampling, such are wave function collapse or Schrodinger’s cat thought experiment, are revealed as being useless ¨inventions. We propose to describe QMS as transmission processes for stochastic data. Note that, for existing quantum debates, the above UR–QMS revaluations, offer a few arguments for lucrative parsimony in approaches of matters. The unlucrative aspects of those debates have to be reconsidered too, probably in more or less speculative visions. (shrink)

The case is discussed for the doctrine of hell as posing a unique problem of evil for adherents to the Abrahamic religions who endorse traditional theism. The problem is particularly acute for those who accept retributivist formulations of the doctrine of hell according to which hell is everlasting punishment for failing to satisfy some requirement. Alternatives to retributivism are discussed, including the unique difficulties that each one faces.

While practical efforts in the field of artificial intelligence grow exponentially, the truly scientific and mathematically exact understanding of the underlying phenomena of intelligence and consciousness is still missing in the conventional science framework. The inevitably dominating empirical, trial-and-error approach has vanishing efficiency for those extremely complicated phenomena, ending up in fundamentally limited imitations of intelligent behaviour. We provide the first-principle analysis of unreduced many-body interaction process in the brain revealing its qualitatively new features, which give rise to rigorously defined (...) chaotic, noncomputable, intelligent and conscious behaviour. Based on the obtained universal concepts of unreduced dynamic complexity, intelligence and consciousness, we derive the universal laws of intelligence applicable to any kind of intelligent system interacting with the environment. We finally show why and how these fundamentally substantiated and therefore practically efficient laws of intelligent system dynamics are indispensable for correct AI design and training, which is urgently needed in this time of critical global change towards the truly sustainable development. We propose a qualitatively new kind of governance for the emerging need to efficiently guide the densely interconnected, ever more complex world development, which is based on explicit and openly presented problem solutions and their interactive implementation practice within the versatile, but unified professional analysis of complex real-world dynamics, involving both the powerful central units and the attached creative worldwide network of professional representatives. We provide fundamental and rigorous scientific arguments in favour of introduction of just that kind of governance (...) at the modern development stage, after the complexity threshold in the real world dynamics evolution (sometimes intuitively designated as "globalisation"), where the traditional spontaneous-empirical kind of development and related administrative governance lose dramatically and inevitably their efficiency and the necessity of explicit consistent understanding and guidance of complex real-world dynamics becomes evident. We examine Sophie Gibb’s emergent property-dualist theory of mental causation as double-prevention. Her account builds on a commitment to a version of causal realism based on a powers metaphysic. We consider three objections to her account. We show, by drawing out the implications of the ontological commitments of Gibb’s theory of mental causation, that the first two objections fail. But, we argue, owing to worries about cases where there is no double-preventive role to be played by mental properties, her account, (...) which solely affords mental properties a double-preventive role, is incomplete and vulnerable to a causal exclusion objection. We propose a friendly modification to her theory of mental causation that is consistent with her theory’s ontological commitments. Specifically, we sketch an account on which mental properties have a more pronounced causal-structuring role that is not exhausted by the role Gibb assigns them as double-preventers. The result is a novel emergentist theory of mental causation. (shrink)

In this article I focus on the argument that Jeff Speaks develops in Speaks (2008). There, Speaks distinguishes between uses of language in conversation and uses of language in thought. Speaks’s argument is that a phenomenon that appears both when using language in communication and when using language in thought cannot be explained in Gricean conversational terms. A Gricean account of implicature involves having very complicated beliefs about the audience, which turn out to be extremely bizarre if the speaker is (...) her own and only audience. Therefore, it is extremely implausible that we implicate anything when using language in thought. So, an episode of using language in thought needs to be explained in some other way. This article is an attempt to clarify the notion of a use of language in thought, and ultimately to argue that there are no uses of language that satisfy all the conditions that are needed for Speaks’s argument to work. Modern fundamental science tends to avoid the principle of physical causality and realism, replacing it with heuristically postulated and separated mathematical constructions that impose their own rules before being adjusted to measurement results. While it is officially accepted as the single possible kind of rigorous knowledge, we argue that another, explicitly extended kind of science can provide the causally complete picture of reality avoiding the glaring gaps, growing problems and persisting stagnation of the artificially reduced knowledge paradigm. The logic of (...) science development and especially its current state call for the urgently needed transition to the extended, causally complete kind of knowledge and related sustainable progress at superior creativity levels of self-aware, reason-based society. Instead of postulated fixed structures and abstract principles of usual positivistic science, the unreduced diversity of living world reality is consistently derived as dynamically emerging results of unreduced interaction process development, starting from its simplest configuration of two coupled homogeneous protofields. The dynamically multivalued, or complex and intrinsically chaotic, nature of these real interaction results extends dramatically the artificially reduced, dynamically single-valued projection of standard theory and solves its stagnating old and accumulating new problems, “mysteries” and “paradoxes” within the unified (...) and causally complete picture of intrinsically evolving, dynamically complex reality. The permanently unfolding complexity progress thus revealed is fundamentally unlimited and does not need to stop at the directly observed diversity of usual matter complexity. The exciting, but rigorously substantiated and objectively inevitable prospects of further civilisation complexity development towards its superior levels of genuine sustainability and global Noosphere are outlined, with practically important conclusions for today’s critical problem solution. We explain why exactly the simplified abstract scheme of reality within the standard science paradigm cannot provide the consistent picture of “truly fundamental” reality and how the unreduced, causally complete description of the latter is regained within the extended, provably complete solution to arbitrary interaction problem and the ensuing concept of universal dynamic complexity. We emphasize the practical importance of this extension for both particular problem solution and further, now basically unlimited fundamental science development (otherwise dangerously stagnating within its traditional (...) paradigm). Unified and causal complex-dynamic origin of standard (special and general) relativistic and quantum effects revealed previously at the lowest levels of world interaction dynamics is explicitly generalised to all higher levels of unreduced interaction processes, thus additionally confirming the causally complete character of complex-dynamical, naturally quantised relativity, which does not contain any artificially added, abstract postulates. We demonstrate some elementary applications of this generalised quantum relativity at higher levels of complex brain and social interaction dynamics.

By “pantheism” I mean to pick out a model of God on which God is identical with the totality of existents constitutive of the universe. I assume that, on pantheism, God is an omnispatiotemporal mind who is identical with the universe. I assume that, given divine omnispatiotemporality, God knows everything that can be known in the universe. This includes having knowledge de se of the minds of every conscious creature. Hence, if God has knowledge de se of the minds of (...) every conscious creature, then divine omniscience implies omnisubjectivity. Assuming that eternalism is true, robust temporal passage is an illusion. But, conscious creatures, such as human persons, experience robust temporal passage. If God has the attribute of omnisubjectivity, then God experiences temporal passage. However, God also has a unified experience of the entire spatiotemporal continuum. God’s having these two perspectives creates a tension for pantheism given that God would seem to experience both temporal passage and an absence of temporal passage. I compare non-personal pantheism and personal pantheism and consider which one has better resources to answer the foregoing puzzle. I argue that personal pantheism is better equipped to address this problem than non-personal pantheism. (shrink)

This summary of the original paradigm of the universal science of complexity starts with the discovered exact origin of the stagnating "end" of conventional, unitary science paradigm and development traditionally presented by its own estimates as the only and the best possible kind of scientific knowledge. Using a transparent generalisation of the exact mathematical formalism of arbitrary interaction process, we show that unitary science approach and description, including its imitations of complexity and chaoticity, correspond to artificial and ultimately strong reduction (...) of the natural plurality of unreduced interaction results called realisations to a single, "average" or "exact", realisation. This severe reduction of the natural world dynamics in unitary science underlies all its unsolvable "mysteries" and "paradoxes", persisting "difficult problems", and finally the modern "end" of the progress of just that, actually very special kind of knowledge, whose irreducible limits lead to the modern deep crisis of the global civilisation development. We show then how the rigorously substantiated restoration of the full richness of real-world dynamics within the intrinsically unified knowledge of the universal science of complexity provides not only the causally complete solution to the old and new problems of unitary science but opens practically unlimited possibilities for the new progress of science and civilisation as a result of this crucial extension, which we call complexity revolution. The unreduced analysis of the universal complexity science shows that at the current critical bifurcation point of development, we have only two incompatible possibilities and emerging tendencies, either the dangerously growing degradation within the dominating unitary science and thinking limits (irrespective of purely empirical technology power becoming even dangerous here) or the new golden age of scientific discoveries and civilisation progress with the qualitatively extended approach and results of unreduced complexity science and the new thinking it implies.
